Terms and Conditions of Sale (Revised 7-12-2005)

The sale represented by this Invoice/Sales Order is subject to the terms and conditions stated herein (the "Terms and Conditions of Sale"). No waiver or amendment to the provisions of the Terms and Conditions of Sale shall be binding on Mirage Jewelers unless approved by Mirage Jewelers in writing. Your order and acceptance of the merchandise that is the subject of this invoice shall be deemed your acceptance of these Terms and Conditions of Sale.


SHIPPING CHARGES

There are no shipping charges. Shipping is free. Your order will be shipped to you fully insured. We urge all customers to inspect your package for damage or tampering before receiving or signing for receipt.

To help you plan when to expect your order, you'll notice an estimated arrival date listed in the the confirmation e-mail you will receive. This is the approximate number of days required to process, package, and deliver your order. For some products, the arrival date is listed in the details. For others, your shipment destination will determine your arrival date.

If you will not be home to sign for your order, Mirage Jewelers can ship your order to your place of work, or another more convenient destination.
As a security precaution to protect our customers against fraud, when you order merchandise priced $1000 or more to be delivered to a destination
other than your billing address, we will confirm that your credit card or financing company has this alternate shipping address on file. To help
expedite your order, simply call your issuing bank and provide them with your alternate shipping address.

If you cannot be available, or have someone else available to sign for your package, you can have it shipped to your local FedEx/UPS location so that you can sign for and pick it up at your leisure. Find the FedEx?UPS location nearest you.

Mirage Jewelers will ship your order free and insured to your doorstep.

If your order is being shipped via FedEx Priority Overnight or 2Day delivery service:

Delivery usually arrives in one or two business days (Monday through Friday) following shipment. Blue Nile will ship only to a street address, not a P.O. Box address. Signature is required for shipments totaling $250 or more, regardless of any waivers you may have with FedEx. If your order is shipped by FedEx Priority Overnight or FedEx 2Day delivery service, a signature is required upon delivery for shipments totaling $250 or more. If you are unable to be available for signature on a weekday, we can arrange a Saturday delivery for an additional fee. E-mail Customerservice@miragejewelers.com and a diamond and jewelry consultant will arrange this for you.

If your order is being shipped by FedEx® Ground:

Delivery usually occurs in one to six business days after it is shipped from Mirage Jewelers. May arrive on Saturday, at no extra charge. Mirage Jewelers will ship only to a street address, not a P.O. Box address. If your order is being shipped to Alaska, Hawaii or an APO or FPO address via USPS Priority Mail:

Delivery usually occurs within three business days after it is shipped from Mirage Jewelers. Mirage Jewelrs will ship only to a street address, not a P.O. Box address.

Because APO & FPO orders must be processed through the military postal service, it may take your package a bit more time to arrive. Mirage Jewelers ships all APO & FPO orders via USPS Priority Mail and guaranteesyour package will arrive at the appropriate APO/FPO processing center within 2-4 days. From that point on, we depend on the military postal service to deliver the package to you in a timely manner. We cannot provide a tracking number or specific delivery date. If you are already familiar with sending packages to APO & FPO addresses, you can probably expect your Mirage Jewelers order to arrive in about the same amount of time.

Your item will be placed in either a tasteful velvet bag, or in a velvet jewelry box tucked inside a gift box. Select items will arrive in distinctive lacquered wooden boxes.

All loose diamonds and rings we set will be delivered via FedEx Priority Overnight®.


TAXES

No taxes will be charged to your purchase. All purchases are DUTY FREE. This is only made possible as all sales are registered under the name Mirage Jewelers which is location on the island of St.Maarten. St.Maarten's Duty free status has made the island a shoppers paradise.

RETURN POLICY
No merchandise may be returned for any reason without Mirage Jewelers's prior written approval, and without the receipt of a return merchandise
authorization number from Mirage Jewlers. Mirage Jewelers will not accept the return of (a) altered, sized or damaged merchandise, or (b)
merchandise for a cash refund, or any credit other than a credit against future purchases. All returns shall be delivered or shipped prepaid to Mirage Jewelers principal place of business in the original packaging and condition, together with the invoice. A complete return policy is available on our web site (www.miragejewelers.com) or by e-mail upon request.


REPAIR CHARGES
Mirage Jewelers represents that the merchandise will conform to the descriptions and specifications on this invoice and be free from defects in material and workmanship. Except as provided herein, Mirage Jewelers makes no warranties, express or implied (including but not limited to, any implied warranties of merchantability or fitness for a particular purpose). If the merchandise does not conform to the above, Mirage Jewelers will, at its sole election, repair or replace the goods, free of charge for a period up to one month from the date of shipment. All other repairs, sizing and other work will be subject to Mirage Jewelers' customary charges.

All stone and gold weights are approximate.


LIMITATION OF LIABILITY
In no event shall Mirage Jewelers be liable for any indirect, special, incidental or consequential damages resulting form Mirage Jewelers's performance or failure to perform under this sale, or the furnishing, performance or use of any merchandise or service provided pursuant hereto, whether due to a breach of contract, breach of warranty, negligence of Mirage Jewlers or otherwise. Mirage Jewelers shall not be liable for any delay in performance directly or indirectly caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labor difficulties, equipment failure, late deliveries by suppliers or other difficulties which are beyond the control of Mirage Jewelers. Quantities are subject to availability. In the event of production difficulties or product shortages, Mirage Jewelers may allocate sales and deliveries at its own discretion.


ATTORNEYS' FEES AND COSTS
If Mirage Jewelers is required to refer this invoice to an attorney to assist in its enforcement following a dispute hereunder and if Mirage Jewelers prevails in such dispute, Mirage Jewelers shall be entitled to recover its reasonable attorneys' fees and costs incurred in connection with such dispute.

All of Mirage Jewelers' merchandise is manufactured overseas

 

30-Day Return Policy:

Our 30-day return policy gives you peace of mind and this way you can be sure you made the right decision. If for any reason you aren't satisfied, you can return any item without custom engraving in its original condition within 30 days of the date of shipment for a refund or an exchange. We can exchange your jewelry for another item, give you another ring size, repair your item, or mount your diamond in a setting. E-mail your contact information to customerservice@miragejewelers.com and a diamond and jewelry consultant will contact you.


Once we receive your returned item and it is accepted, your refund or new item will be processed in just a few days. Upon receiving your return, the item will be reviewed by our Quality Assurance department. Please note that items showing signs of wear or those that have been engraved, altered, resized (by a jeweler other than Mirage Jewelers), or damaged in any way cannot be accepted for return. Returns with no Mirage Jewelers return code, and packages that are improperly packaged or uninsured will be refused receipt.

To return a diamond or jewelry item to Blue Nile, follow our three step process: Your Return Authorization Code. E-mail customerservice@miragejewelers.com and you will be given a Return Authorization Code. Write this code on the return sticker found at the bottom of your original invoice. Affix the sticker to the outside of the box you are returning.

Package Your Return. Place all the original packaging in the box, including the appraisal and the diamond certificate. (The diamond certificate carries a $250 replacement fee.) For security reasons, do not write Mirage Jewelers anywhere on the outside of the box.

Insure Your Package. On your invoice, if the price of the item you're returning is listed as:

Less than $500: You can ship it via any carrier. Be sure to ship your item fully insured, and request a return receipt for confirmation that your
shipment has reached its destination.* More than $500: Ship your package via US Postal Service Registered MailT, insured for the total value of the contents, and request a return receipt for confirmation that your shipment has reached Mirage Jewelers.* (FedEx® and UPS® will not insure merchandise over $500.) * Mirage Jewelers will not be responsible for loss or damage of return shipments.
